En créant un compte KL Pay, en utilisant un terminal SUNMI fourni par KL Pay ou en accédant au tableau de bord marchand, vous acceptez d’être lié par les présentes conditions. Si vous n’êtes pas d’accord, vous ne pouvez pas utiliser le service.
KL Pay est une plateforme qui permet aux entreprises enregistrées en Haïti d’accepter des paiements mobiles via MonCash et NatCash sur des terminaux de paiement SUNMI. Les fonds sont collectés par KL Pay puis reversés aux marchands, après déduction des frais applicables.
Pour utiliser KL Pay en tant que marchand, vous devez :
Vous êtes responsable de la confidentialité de vos identifiants (mots de passe, codes PIN, jetons d’accès) et de toutes les activités effectuées sur votre compte. Vous devez notifier KL Pay immédiatement en cas de perte d’un terminal ou de compromission d’un compte.
Vous ne pouvez pas utiliser KL Pay pour :
Les frais applicables à chaque méthode de paiement (MonCash, NatCash) sont communiqués lors de l’inscription et peuvent figurer dans votre tableau de bord. KL Pay se réserve le droit de modifier les frais moyennant un préavis raisonnable.
Les versements aux marchands sont effectués selon une fréquence convenue (quotidienne, hebdomadaire, à seuil, etc.) et dépendent de la disponibilité des fonds auprès des opérateurs mobiles.
Les remboursements sont à l’initiative du marchand. KL Pay peut refuser ou bloquer un remboursement s’il soupçonne une fraude. Toute contestation d’une transaction doit être signalée à info@kl-pay.com dans les trente (30) jours.
KL Pay fait ses meilleurs efforts pour maintenir le service disponible 24/7, mais ne garantit pas une disponibilité ininterrompue. Le service dépend également de la disponibilité des opérateurs MonCash et NatCash, sur laquelle KL Pay n’a pas de contrôle direct.
Le logiciel, le design, les marques et tout le contenu de la plateforme KL Pay sont la propriété de KES LAKAY. Aucune licence ou droit n’est accordé en dehors du droit d’utiliser le service conformément à ces conditions.
Dans les limites autorisées par la loi, la responsabilité totale de KL Pay envers un marchand est limitée au montant des frais payés par ce marchand au cours des trois (3) derniers mois. KL Pay n’est pas responsable des pertes indirectes, du manque à gagner ou des interruptions d’activité.
Chaque partie peut mettre fin à l’accord moyennant un préavis de trente (30) jours. KL Pay peut suspendre ou résilier immédiatement un compte en cas de fraude avérée, de violation des conditions ou de demande d’une autorité compétente.
KL Pay peut modifier ces conditions. Les modifications importantes seront notifiées par email ou dans le tableau de bord. L’utilisation continue du service après notification vaut acceptation.
Les présentes conditions sont régies par le droit haïtien. Tout litige sera soumis à la compétence exclusive des tribunaux de Port-au-Prince.

Se machàn ki inisye ranbousman yo. KL Pay ka refize oswa bloke yon ranbousman si l sispèk fwod. Tout kontestasyon sou yon tranzaksyon dwe siyale nan info@kl-pay.com nan trant (30) jou.
KL Pay ap fè tout efò pou kenbe sèvis la disponib 24/7, men li pa garanti yon disponiblite san entèripsyon. Sèvis la depann tou sou disponiblite operatè MonCash ak NatCash yo, bagay KL Pay pa ka kontwole dirèkteman.
Lojisyèl, dezen, mak komèsyal, ak tout kontni platfòm KL Pay se pwopriyete KES LAKAY. Pa gen okenn lisans oswa dwa ki bay andeyò dwa pou itilize sèvis la dapre kondisyon sa yo.
Nan limit lwa a pèmèt, responsablite total KL Pay anvè yon machàn limite nan montan frè machàn nan peye pandan twa (3) dènye mwa yo. KL Pay pa responsab pèt endirèk, manke nan pwofi, oswa entèripsyon aktivite.

By creating a KL Pay account, using a SUNMI terminal provided by KL Pay, or accessing the merchant dashboard, you agree to be bound by these terms. If you do not agree, you may not use the service.
KL Pay is a platform that allows businesses registered in Haiti to accept mobile payments through MonCash and NatCash on SUNMI payment terminals. Funds are collected by KL Pay and then paid out to merchants, net of applicable fees.
To use KL Pay as a merchant, you must:
You are responsible for keeping your credentials (passwords, PIN codes, access tokens) confidential and for all activity performed on your account. You must notify KL Pay immediately if a terminal is lost or an account is compromised.
You may not use KL Pay for:
Fees applicable to each payment method (MonCash, NatCash) are disclosed at signup and may appear in your dashboard. KL Pay reserves the right to change fees with reasonable prior notice.
Payouts to merchants are made at an agreed frequency (daily, weekly, threshold-based, etc.) and depend on the availability of funds from the mobile operators.
Refunds are initiated by the merchant. KL Pay may refuse or block a refund if it suspects fraud. Any transaction dispute must be reported to info@kl-pay.com within thirty (30) days.
KL Pay makes best efforts to keep the service available 24/7 but does not guarantee uninterrupted availability. The service also depends on the availability of MonCash and NatCash, over which KL Pay has no direct control.
The software, design, trademarks, and all content of the KL Pay platform are the property of KES LAKAY. No license or right is granted beyond the right to use the service in accordance with these terms.
To the extent permitted by law, KL Pay’s total liability to a merchant is limited to the amount of fees paid by that merchant during the three (3) preceding months. KL Pay is not liable for indirect losses, lost profits, or business interruption.
Either party may terminate the agreement with thirty (30) days’ prior notice. KL Pay may suspend or terminate an account immediately in case of proven fraud, breach of these terms, or at the request of a competent authority.
KL Pay may update these terms. Material changes will be communicated by email or in the dashboard. Continued use of the service after notice constitutes acceptance.
These terms are governed by Haitian law. Any dispute shall be submitted to the exclusive jurisdiction of the courts of Port-au-Prince.
